Pugh Calls on Department of Health to Reclassify Narcotic

HARRISBURG – State Rep. Brenda Pugh (R-Luzerne) today announced that she has sent a letter to Dr. Debra Bogen, secretary for the Pennsylvania Department of Health (DOH), urging the Commonwealth to prepare for prompt action should the U.S. Drug Enforcement Administration (DEA) finalize its proposed temporary Schedule I classification of 7-hydroxymitragynine (7-OH).
The DEA recently announced its intent to temporarily classify 7-OH as a Schedule I controlled substance, citing the significant danger it poses to public health and safety.
“As lawmakers, our responsibility is to stay ahead of emerging threats and not wait until they become larger public safety problems,” Pugh said. “The DEA’s announcement is an important step, and Pennsylvania should be prepared to act quickly if the federal scheduling becomes final.”
Pugh has spent the past several months meeting with local law enforcement, healthcare professionals, community leaders and federal officials regarding the increasing availability of highly concentrated 7-OH products throughout Pennsylvania.
“I’ve heard firsthand from law enforcement officers, medical professionals, addicts and families who are deeply concerned about these products,” Pugh said. “They’re often marketed in ways that minimize their potency and potential dangers, creating serious risks for consumers and our communities.”
In her letter, Pugh asked Dr. Bogen to begin preparing for any necessary action under Pennsylvania law so the Commonwealth can respond promptly should the DEA finalize its temporary Schedule I designation.
“My goal is simple,” Pugh said. “If the federal government determines 7-OH should be temporarily classified as a Schedule I substance because of the danger it presents, Pennsylvania should be ready to respond without unnecessary delay. Consistency between federal and state law helps provide clarity for law enforcement, prosecutors, healthcare providers, retailers and the public.”
Pugh also requested information regarding the department’s anticipated process and timeline for implementing any corresponding changes to Pennsylvania’s controlled substance schedules following final federal action.
“I appreciate the collaboration of our local, state and federal partners who have worked together to bring attention to this issue,” Pugh added. “Protecting Pennsylvanians from emerging and dangerous substances requires cooperation, communication and a willingness to act when public safety is at stake.”
Pugh concluded by expressing her willingness to work with DOH and other stakeholders to ensure Pennsylvania is prepared to respond effectively as the issue continues to evolve.
